Terms of Service

1. The service

Made When Little (“MWL,” “we,” “us,” or “our”) provides tools for adults to save, organize, and revisit family memories, including photographs of children’s creations and meaningful objects, titles, dates, tags, and voice recordings.

MWL is a convenience, not a permanent archival or backup service. Technology can fail, and we may change or discontinue features. Keep independent copies of content that is important to you.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use MWL. The service is intended for parents, guardians, and other adults. It is not directed to children, and children may not create accounts.

You are responsible for accurate account information, the security of your account and sign-in links, and activity under your account. Contact privacy@madewhenlittle.com promptly if you suspect unauthorized access.

3. Your content

You retain ownership of photos, recordings, text, and other material you upload or create through MWL (“Your Content”). You give us a limited, worldwide, non-exclusive license to host, store, copy, process, transmit, display, and create technical derivatives of Your Content only as reasonably necessary to operate, secure, support, and improve MWL, comply with law, and carry out your instructions.

You represent that you have all rights and permissions needed to upload Your Content and allow this processing. This includes any consent required to photograph or record another person, including a child, and respecting privacy, publicity, copyright, and other rights.

You may not upload unlawful, exploitative, abusive, infringing, deceptive, malicious, or harmful content. We may remove content or restrict an account when reasonably necessary to protect people, the service, or comply with law.

4. Automated and third-party processing

To provide core features, uploaded images may be sent to specialized service providers for background removal and AI-assisted title generation. Other providers help with hosting, storage, authentication, analytics, and billing. Our Privacy Policy describes these provider categories and the information involved.

Automated results may be incomplete, inaccurate, or unexpected. You are responsible for reviewing and editing them before relying on them.

5. Subscriptions and billing

Some features require a paid subscription. Prices, included features, and billing periods are shown before purchase. Subscriptions renew automatically at the then-current price unless you cancel before the renewal date. A third-party payment processor handles payments; we do not receive or store your complete payment-card number.

You may cancel through the billing tools in Settings. Cancellation stops future renewal and generally takes effect at the end of the paid period. Except where required by law or expressly stated otherwise, fees already paid are non-refundable. You are responsible for applicable taxes.

We may change pricing or plan features prospectively. When legally required, we will give advance notice and an opportunity to cancel before a change applies.

6. Acceptable use

You may not misuse MWL or help anyone else do so. You may not:

• access another person’s account or content without authorization;
• probe, disrupt, overload, scrape, reverse engineer, or bypass security or usage limits;
• use MWL to violate law or another person’s rights;
• upload malware or content that exploits or endangers a child; or
• resell or commercially exploit MWL without our written permission.

7. Our intellectual property

MWL and its software, design, branding, text, and other materials—excluding Your Content—are owned by us or our licensors and protected by law. These Terms give you a limited, personal, non-transferable, revocable right to use MWL for its intended purpose; they do not transfer ownership of our intellectual property.

If you send feedback, you allow us to use it without restriction or compensation.

8. Suspension and termination

You may stop using MWL at any time and may request account deletion by contacting us. We may suspend or terminate access if you materially breach these Terms, create risk or harm, fail to pay amounts due, or if required by law. Where reasonable, we will provide notice and an opportunity to retrieve content.

Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, limitations of liability, and indemnity—will survive.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MWL IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT MWL WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT CONTENT WILL NEVER BE LOST.

Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MWL AND ITS OPERATORS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, CONTENT, GOODWILL, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY ARISING OUT OF MWL OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MWL DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. These limits do not apply where prohibited by law.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MWL and its operators from claims, losses, liabilities, and reasonable expenses arising from Your Content, your misuse of MWL, your violation of these Terms, or your violation of another person’s rights.

12. Governing law

These Terms are governed by California law, without regard to conflict-of-law principles. Any dispute not required by law to be heard elsewhere will be brought in a court of competent jurisdiction in California. Nothing here limits consumer rights that cannot be waived.

13. Changes and general terms

We may update these Terms as MWL evolves. If a change is material, we will provide reasonable notice through MWL, by email, or by updating the effective date. Continued use after revised Terms take effect means you accept them.

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets.
